.Our graphics are legally registered to Angelina Hedgepeth trading as Promo Tees and Designs. For the purpose of this License, when making reference to us we will say; Promo Tees or Promo Tees and Designs. If for some reason you are unsure of how you can legally use Promo Tees and Designs graphics or you have suggestions, question, etc. on improving this licensing agreement please feel free to write us.
We retain all copyrights and other rights to our graphics and other works sold to the public.
Do I have to register if I purchase your CD(s)?
Yes, if you plan to use our graphics for commercial purposes. That means if you plan to sell items you produce that contain our graphics. By registering you protect yourself and us from illegal use. Registration provides us with a list of legal users of our graphics and helps us readily identify those who are illegally using our graphics so we can legally pursue those willfully violating our license. If you decide to use our graphics then make sure you register your copy by visiting; http://www.pcbbkits.com/register.shtml. We'll need to know; your Name, Business Name, mailing address, Tax ID Number (if you have one) and your website(s) URLs. What can Promo Tees and Designs graphics be used for?
We tried to be as free as possible with your uses. However, simply put you can use our graphics for any use that is NOT listed in our " What you ARE NOT permitted to use Promo Tees and Designs graphics for " section" of this license. Our goal is to provide quality artwork to people who operate small businesses (normally home based) who wish to create hand finished merchandise to sell for a profit.
Promo Tees and Designs graphics can not be used on items that are mass produced (unless you obtain prior "written" permission from us, which will require a separate licensing fee). We do not intend for our graphics to be to put on items that are sold in retail stores. However, if you do want to mass produce an item for that purpose, licensing fees are available (per image desired). "Mass Production" is defined as making items that have not been ordered or items that you intend on selling to people to hold as "stock" in a store or otherwise. Our license is intended for YOU the home business owner to use in YOUR business, for orders that have been placed with you or for products you intend on selling to the public (but "not" to retail establishments). For example, you should not, under our license, make 100 mousepads to sell to Kmart, Target, etc. or to a local business in your town. However, you COULD make 100 mousepads that have been ordered from you by the "public" (not a retail establishment) or make 100 mousepads for YOURSELF to sell at a flea market or other sales outlet that you participate in. Basically…if you handcraft a product using our graphics (pursuant to this license) and sell it directly to the public you are ok.
Can people who wrap candy make 100’s or 1000’s of candy wrappers and not violate this license agreement?
Yes, The mass production limitation doesn't apply to people who wrap candybars as long as they are using the images for wrappers that have been ordered (as opposed to just printing up 1000 wrappers to try to sell them to a chain store or bridal shop).
Can paper piecings (for scrapbooking) be made from the files and not violate this license agreement?
Yes, paper piecings can be made from the files on our CDs. You may sell your finished product, but you man NOT sell the files or patterns from the CD. You may not claim that you are the creator of the characters/graphics on our CD and we ask that you give some credit in your advertising that the characters/graphics you are using are "Promo Tees" graphics.
Can Promo Tees and Designs Distributors use files at their websites to download ?
No, Promo Tees and Designs distributors can not sell, re-sell, offer or give our wrapper (and other) files to anyone. They can NOT be used at a website if they are to be downloaded by a customer or anyone else. Our files may be used on a website to show a customer what you are offering. We would appreciate it if the word "Sample" or some other word was put over the graphic when it is shown to customers. This protects both of us.
Can I use Promo Tees and Designs graphics and templates and offer them to people on my website for download?
You are forbidden to use our graphics, templates or other files to others via download. That means you ARE NOT permitted to offer Promo Tees and Designs graphics, wrappers, templates, etc... in ANY way digitially (through files, on a CD, via download, etc...). You can NOT use our graphics for any online club or group where people would be downloading files or you would be offering our files to them in any way.. You can NOT offer our graphics for download digitally on items you make IF those items are offered digitally. For instance, if you make a bookmark with one of our graphics you can sell that bookmark (already made) to a customer, but you can NOT offer the bookmark file as a download to anyone because it contains our graphics. This guards against people trying to get around our licensing agreement.
What you ARE NOT permitted to use Promo Tees and Designs
graphics for:
- plates
- mass produced items
- sculptures, molds, statues, figurines
- digitized images which you sell, give away, barter away or offer for download or in ANY digital form
- embroidery images which you sell (but you can use the images on handmade clothing that you sell)
- items sold in retail stores that have not purchased our graphics or a license for our graphics
- graphic swaps, on mailing lists or any other form of sharing
- shoe wear
- Stuffed animals and/or toys or dolls
- Use in any other graphics package or in any graphics collection. This INCLUDE any "new" graphics you make by adding some new element, color, item, etc..to our graphic
- As part of a "template" or "pattern" you sell, offer, barter or give to others.
- Use in logos or any other use that would associate the images with any one business other Promo Tees and Designs or Angelina Hedgepeth.
- As "wallpaper" for e-mails or any other e-mail type artwork (including but not limited to electronic greeting cards).
- Lawn ornament or templates to make lawn ornaments.
- As characters or represented in any books or other written material
- Storybooks or other "book" type materials
- Fabric
- Metal plates
You can use our graphics for newsletters and articles. We ask that you notify us of your intent to use our graphics for such purposes and we also ask that you include credit to Promo Tees and Designs for the graphics and reference to http://www.pcbbkits.com
What can I do with the Promo Tees and Designs files that are on the CD?
The only thing you can do with the Promo Tees and Designs files that are on your CD is use them for you OWN use. You can not share the files, sell the files, give the files as a gift, or give them away (in any form) to anyone else. You can back up the files on your computer in case your computer crashes and you need to re-install your computer operating system. You can also make copies of the CD for you OWN personal use. Copying the CD for ANY other purpose is a violation of this agreement.
No, you can not share any information found in our kits, with others. That includes forums you belong to, by email, verbally, in written form or by any other form of communication. You may only discuss the information contained in the kit(s) with other Distributors on the Distributor’s forum. You are free to talk in general terms on public forums about the kit such as; "I like the kit", "I liked the bonus software the kit recommends", "I dislike the kit because...", "I didn’t find the bonus software useful but I liked the kit", etc. We’ve worked hard to provide a useful source of information to help "you generate income" for "your" business. If you share our information you prevent "us" from generating "income" for "our" business.
What would happen if I violate this agreement?
The Kit:
If you share information that’s exclusive to Distributors it could result in your "distributor’s license" being revoked. Which means you will no longer be able to sell the wrapper designs, use the clipart, etc. for business and or personal use. Our Graphic CDs, Designs, Videos, Tutorial, etc.: We have filed a copyright for our artwork with the United States government which makes it MANDATORY that we contact anyone that violates our copyright by send them a warning in the form of a "cease and Desist" order. Once they have been warned if they elect to ignored us we have no other recourse but to sue the person/business involved. If we fail to enforce our copyright we lose our personal copyright to our artwork. We are simply someone doing something that we are legally bound to do to protect our own rights.
